Effective Date of the New Patent Law Treaty Implementation Act

The effective date of the Patent Law Treaty Implementation Act is December 18, 2013.  The new law applies retroactively to patents granted before that date, as well as to patents granted, on or after that date, and to patent applications pending on or filed after that date. However, the changes relating to filing dates and priority claims apply only to applications filed on or after December 18, 2013.  But none of the changes apply with respect to any patent that is the subject of litigation in an action commenced before the effective date.
